This website is owned and operated by Ben Summers (referred to hereafter as 'Ben' , 'we' and 'our' in the following terms and conditions). All content on this website, including designs, images, text, photographs etc is owned by 'Ben' or our content providers. All content is protected by English and International copyright laws.

Terms of Use

Pop God provides this website and all services/products subject to the following conditions:

• As a user of this website you are legally bound to the following terms and conditions. If you do not agree to be bound by the following terms and conditions please do not use or access Pop God.

• Pop God can alter and amend any of these terms and conditions without notice. Your use of the website after any change in the terms and conditions means you agree with the changes and are legally bound by the terms of use.

• You may not copy, reproduce, republish, download, broadcast, transmit or otherwise use the content contained on this website in any way including  for your own personal or non-commercial use without prior written consent from Pop God.

Limitation of Liability

Neither 'Pop God', 'Ben Summers', its directors nor its owner, trader, operator, associates or content providers will be liable for any damages, including indirect or consequential damages, or any damages arising from the use of this website or products/services ordered from it.

Your Agreement

• You confirm that you are over 18 years old

• You are the legal owner of any payment facility used for purchases on this website

• You are the legal owner or have the consent of the legal owner of any photograph or image you use for your Pop God artwork

• You confirm that the delivery address is your own or that of a person who is legally allowed to receive products using the payment method chosen

Our Agreement

• All products and services will be provided free of defects and without damage

• All customer details will be held securely by ourselves for contact purposes and will not be shared with any 3rd party

• Payment details will not be held by Pop God directly. All transactions and payment details will be handled by Paypal.

• We will endeavour to resolve any payment or product dispute promptly and in accordance with English law

Photographs and images sent to Pop God

It is solely the responsibility of the person sending the photograph/image to ensure they have the permission of the copyright owner of the image.

By sending a photograph/image to Pop God.co.uk you warrant that:

• The image is your own or you have the written permission of the copyright owner and have the right to allow Pop God to use the image for the purpose of creating personalised artwork

• The image does not infringe any law

• You indemnify Pop God and its owners against all legal fees, damages and other expenses that may be incurred by Pop God as a result of your breach of the above warranty

• You waive any moral rights in your contribution for the purposes of its submission to and publication on the site

• All subjects contained in the photograph/image have given their consent for its use

Artwork

Pop God retains complete artistic licence with all personalised portraits. We aim to satisfy all customers and provide artworks closely resembling every photographic subject supplied, however please note - upon ordering a Pop God portrait you agree that any portrait provided will be our interpretation of the subject.

Artwork Ownership

All images and text contained on www.popgod.co.uk are the property of Pop God Personalised Portraits. You may not download, copy or duplicate any images without written permission.

Please note: Pop God retains the copyright of all personalised artworks and no copying, duplication or distribution is allowed without written permission. If you wish to purchase the copyright of your own personlised portrait, please contact Pop God to discuss the appropriate fee.

Author Amends

At Pop God's discretion, when we deem further amendment is an unreasonable request, we reserve the right to charge £15 each time you request further amendments to your personalised portrait - not including the first set of author amendments.

Payment

All prices on this website are approximate. The total cost of each order will be clearly detailed before you proceed with payment.

All credit and debit card transactions will be subject to validation checks and authorisation by both the card issuer as well as Paypal (our secure payment platform provider). If your payment method is not authorised we will not proceed with the order and will not be liable for any delay or non-delivery of product(s) as a result. Pop God will endeavour to contact you immediately if we experience problems with your chosen payment method, however if a replacement payment method can not be provided the order will be cancelled and Pop God will not have entered into a contract to provide the service/product agreed.

By purchasing any service or product from Pop God you specifically authorise Paypal to obtain certain information about you from certain third parties specific to financial institutions including but not limited to your debit & credit card details, to authenticate your identity, to validate your payment method (e.g. credit card), to obtain a credit card authorisation and to authorise purchase transactions.

Prices

Pop God reserves the right to amend all prices without notice. 

Pop God reserves the right to request additional payment if the photograph provided does not match the selected personalisation (e.g. payment has been received for a personalised portrait of one person, but the required artwork actually contains more people) or if Pop God deems that the complexity of the artwork is not fairly covered by the payment received (e.g. the photograph contains far more people than is reasonable for the '9+ person/faces' selection) - although this is an extremely rare occurrence.

Transaction Refusal

Pop God reserves the unconditional right to withdraw any product or service from our website at any time. We also reserve the unconditional right to refuse to process any transaction for any reason at our sole discretion.

Promotional Codes

Pop God reserves the unconditional right to withdraw any promotional or discount code at any time. We also reserve the unconditional right to refuse to process any transaction containing a promotional code. Every promotional and discount code has an expiry date - please contact Pop God if you are unsure whether your promotional code is still valid.

Disclaimers

Our site and its contents are provided to you on an 'AS IS' basis. We make no warranties of any kind, either expressed or implied, including but not limited to, on the use of it for any purpose.

We make no representations or warranties as to the accuracy, correctness or reliability of the content contained within this site. We accept no liability for any inconvenience or damage caused by the use of this website.
